Accepting these Terms

This document and the other documents that we reference below make up our Terms of Use (hereinafter referred to as "Terms"). The Terms are a legally binding contract between you and BlogShops. This contract sets out your rights and responsibilities when you use the services provided by BlogShops (hereinafter, we will refer to our website, blogshops.com, and other services as our "Services"), so please read it carefully. The term "Website" in these Terms shall refer to BlogShops.com. By using any of our Services (even just browsing our Website), you're agreeing to the Terms. If you don't agree with the Terms, you may not use our Services.

Terms for Buyers and Sellers

Our Terms of Use for Sellers. If you list any items for sale through our Services, you also agree to our Policies for Sellers, Checkout Policy, and Acceptable Use Policy as part of these Terms. Sellers are responsible for items they list and ensuring that the items they list do not violate any local, state, or federal trade laws.

Our Terms of Use for Buyers. If you make a purchase through our Services, you also agree to our Checkout Policy as part of these Terms.

Privacy Policy

Your privacy is very important to us. Our Privacy Policy explains how your information is used when you use our Services, and it's also a part of our Terms, so please read it here.

BlogShops Accounts

In order to use some of our Services, you'll have to create a BlogShops account. An account is created for you when you "sign in" to BlogShops using a third-party application or when you make a purchase on the site as a guest. If you forget or do not know your password, you can initiate a reset password request.

A. You must be 18 or older to use our Services. If you are under 18 years of age, you may only use our Services under the supervision of a parent or legal guardian.

B. Honesty is essential. You agree to provide accurate information about yourself. The use of false information or impersonation of another person or company through your account is not permitted and will at a minimum result in termination of your account and a lifetime ban from BlogShops.

C. You must be polite. A username that is offensive, vulgar, or infringes someone's intellectual property rights violates the Terms. In addition, any comments, items descriptions, images, or additional content that is deemed offensive by BlogShops violates the Terms and is subject to removal from the site. BlogShops reserves the right to deactivate accounts and ban users based on inappropriate content. BlogShops.

D. Be responsible. You are solely responsible for all activity on your account, even if you share an account with other people. If you sell items on the Website, you personally guarantee that you have the authority to agree to the Terms on behalf of the business you represent. Accounts are not transferrable.

E. Protect your password. Keep your password secure at all times. As we mentioned above, you are responsible for activity on your account, so it is important that you keep your account information secure.

F. Be clear about our relationship. Creating an account with BlogShops or using our Services makes you an independent contractor with BlogShops. No agency, partnership, joint venture, employment or franchisee relationship with BlogShops is intended or created by the Terms.

Your Content

Any content that you post using our Services is your content (hereinafter referred to as "Your Content"). BlogShops makes no claim to Your Content. That includes anything you post using our Services (profile pictures, images, item descriptions, reviews, comments, etc.).

A. You are Responsible for Your Content. You understand that you are solely responsible for Your Content. You represent that you have all necessary rights to Your Content and that you're not infringing or violating any third party's rights by posting it.

B. You Grant BlogShops Permission to Use Your Content. By posting Your Content through our Services, you grant BlogShops a license to use it. We don't claim any ownership to Your Content, but we have your permission to use it to help BlogShops function and grow. That way, we won't infringe any rights you have in Your Content and we can help promote your shop.

C. Rights You Grant BlogShops. By posting Your Content, you grant BlogShops a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of Your Content to provide the Services and to promote BlogShops, your BlogShops shop, or the Services in general, in any formats and through any channels, including across any BlogShops Services or third-party website or advertising medium.

D. Reporting Unauthorized Content. BlogShops greatly respects intellectual property rights, and is committed to following legal procedures to remove infringing content from the Services. If content that you own or have rights to has been posted to the Services without your permission and you want it removed, please contact us.

E. Inappropriate, False or Misleading Content. In order to keep BlogShops happy, there are types of content we don't want posted on BlogShops's Services. You agree that you will not post any content that is abusive, threatening, defamatory, vulgar, obscene, or otherwise offensive or in violation of any part of our Terms. You also agree not to post any content that is false and misleading or uses the Services in a manner that is fraudulent or deceptive. Inappropriate content will be removed solely at our discretion.

Your Use of Our Services

License to Use Our Services. We grant you a limited, non-exclusive, non-transferable and revocable license to use our Services- subject to the Terms and the following restrictions:

  • A. Don't Use Our Services to Break the Law. You agree that you will not violate any laws in connection with your use of the Services. This includes any local, state, federal and international laws that may apply to you. For example, it's your responsibility to obtain any permits or licenses that your shop requires; you may not sell anything that violates any laws; and don't commit fraud, theft or any other crimes against BlogShops, another BlogShops user or a third party.
  • B. Pay Your Bills. You are responsible for paying all fees that you owe to BlogShops. You are also solely responsible for collecting and/or paying any applicable taxes for any purchases or sales you make through our Services. Your fees, bills, taxes and how you can pay them are fully explained in our Terms for Sellers.
  • C. Don't Steal From Us. You agree not to "crawl," "scrape," or "spider" any page of the Services or to reverse engineer or attempt to obtain the source code of the Services.
  • D. Don't Try to Harm Our Services. You will not distribute any virus or other harmful computer code through the Services.
  • E. Share Your Ideas. We love to hear your suggestions and ideas! Any unsolicited ideas or other materials you submit to BlogShops (not including Your Content or items you sell through our Services) are considered non-confidential and non-proprietary to you. You grant us a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use and publish those ideas and materials for any purpose, without compensation to you.
  • F. Talk to Us Online. BlogShops communicates with you electronically (via email, web forms, etc.). Your electronic agreement is the same as your signature on paper.

Termination

Termination By You. We never like to see users go, but we make it easy yo terminate your account with BlogShops from your account settings. If you need any help terminating your account, please contact us.

Termination By BlogShops. We may terminate or suspend your account and your access to the Services at any time, for any reason, and without advance notice. If we do so, it's important to understand that you don't have a contractual or legal right to continue to use our Services, for example, to sell or buy on our website. BlogShops may refuse service to anyone, at any time, for any reason.

If you or BlogShops terminate your account, you may lose any information associated with your account, including Your Content.

We May Discontinue the Services. BlogShops reserves the right to change, suspend or discontinue any of the Services at any time, for any reason. We will not be liable to you for the effect that any changes to the Services may have on you, including your income or your ability to generate revenue through the Services.

Survival. We may terminate or suspend The Terms will remain in effect even after your access to the Service is terminated, or your use of the Service discontinues.

Warranties and Limitation of Liability

Items You Purchase. You understand that BlogShops does not manufacture, store or inspect any of the items sold through our Services. We provide the venue; the items in our marketplace are produced and sold directly by independent sellers, so BlogShops cannot and does not make any warranties about their quality, safety or even their legality. Any legal claim related to an item you purchase must be brought directly against the seller of the item. You release BlogShops from any claims related to items sold through our Services, including for defective items, misrepresentations by sellers or items that caused physical injury (like product liability claims).

Content You Access. You may come across materials that you find offensive or inappropriate while using our Services. We make no representations concerning any content posted by users through the Services. BlogShops is not responsible for the accuracy, copyright compliance, legality or decency of content posted by users that you accessed through the Services. You release us from all liability relating to that content.

People You Interact With. You can use the Services to interact with other individuals, either online or in person. However, you understand that we do not screen users of our Services, and you release us from all liability relating to your interactions with other users. Please be careful and exercise caution and good judgment in all interactions with others, especially if you are meeting someone in person.

Third-Party Services. Our Services may contain links to third-party websites or services that we don't own or control (for example, links to Facebook, Twitter, Pinterest, and Stripe, among others). You may also need to use a third party's product or service in order to use some of our Services. When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. BlogShops is not a party to those agreements; they are solely between you and the third party.

Warranties. Our Services are provided "as is" and without any kind of warranty (express or implied). We are expressly disclaiming any warranties of title, non-infringement, merchantability and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing or usage of trade.

We do not guarantee that: (i) the Services will be secure or available at any particular time or location; (ii) any defects or errors will be corrected; (iii) the Services will be free of viruses or other harmful materials; or (iv) the results of using the Services will meet your expectations. You use the Services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.

Liability Limits. To the fullest extent permitted by law, neither BlogShops, nor our employees or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special or punitive damages arising out of or in connection with the Services or these Terms. In no event shall BlogShops's aggregate liability for any damages exceed the greater of one hundred ($100) US Dollars or the amount you paid BlogShops in the past twelve months. Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.

Indemnification

We hope this never happens, but if BlogShops gets sued because of something that you did, you agree to defend and indemnify us. That means you'll defend BlogShops (and any of our employees) and hold us harmless from any legal claim or demand (including reasonable attorney's fees) that arises from your actions, your use (or misuse) of our Services, your breach of the Terms or your account's infringement of someone else's rights.

We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.

Disputes with Other Users

If you find yourself in a dispute with another user of BlogShops's Services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.

When necessary, BlogShops will attempt to help you resolve disputes in good faith and based solely on our interpretation of our policies, in our sole discretion; we will not make judgments regarding legal issues or claims. BlogShops has no obligation to resolve any disputes.

Release of BlogShops. You release BlogShops from any claims, demands and damages arising out of disputes with other users or parties.

Disputes with BlogShops

If you have a problem with BlogShops, let us know, and hopefully we can resolve your issue. But if we can't, then these rules will govern any legal dispute involving our Services:

A. Governing Law. The Terms are governed by the laws of the State of New Hampshire, without regard to its conflict of laws rules, and the laws of the United States of America. These laws will apply no matter where in the world you live.

B. Arbitration. You and BlogShops agree that any dispute or claim arising from or relating to the Terms shall be finally settled by arbitration, using the English language, administered by the American Arbitration Association (the "AAA") under its Commercial Arbitration Rules then in effect (those rules are deemed to be incorporated by reference into this section). Our arbitration will be handled by a sole arbitrator in accordance with those rules. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under the Terms will take place on an individual basis: class arbitrations and class actions are not permitted. You understand that by agreeing to the Terms, you and BlogShops are each waiving the right to trial by jury or to participate in a class action. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, pending a final decision by the arbitrator.

C. Forum. We're based in Rockingham County, New Hampshire, so any legal action against BlogShops related to our Services must be filed and take place in Rockingham County. That means the seat of any arbitration shall be Rockingham County. For any actions not subject to arbitration, you and BlogShops agree to submit to the personal jurisdiction of a state court located in Rockingham County, New Hampshire or the United States District Court for the District of New Hampshire.

If you are a government agent or entity in the United States using the Services in your official capacity, and you are legally unable to agree to the clauses in this section, then those clauses do not apply to you. In that case, the Terms and any action related to the Terms will be governed by the laws of the United States (without reference to conflict of laws) and, in the absence of federal law and to the extent permitted under federal law, the laws of the State of New Hampshire.

Changes to the Terms

We may update these Terms from time to time. If we believe that the changes are material, we'll definitely let you know by doing one (or more) of the following: (1) posting the changes through the Services or (2) sending you an email or message about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.

We may update these Terms from time to time. If we believe that the changes are material, we'll definitely let you know by doing one (or more) of the following: (1) posting the changes through the Services or (2) sending you an email or message about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Services following the changes constitutes your acceptance of the updated Terms.

Some Additional Legal Information

The Terms, including all of the policies that make up the Terms, supersede any other agreement between you and BlogShops regarding the Services. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms. We may assign any of our rights and obligations under the Terms.

Checkout Policy

Checkout on BlogShops allows buyers to use various forms of payment to purchase items from sellers. This policy explains all of your rights and obligations when using Checkout.

Accepting these Terms

Our Checkout Policy is also a part of our Terms of Use. By using any of our Services, you're agreeing to the Terms of Use.

Overview

Checkout allows sellers to (a) accept payment by authorized credit transactions (b) have those funds credited to a seller's payment processing account (hereinafter also referred to as Payment Account), and (c) have those funds deposited into a seller's designated bank account.

Checkout is only available to buyers and sellers who are at least 18 years old who register and are approved for, or previously registered and were approved for, an authorized payment processing account.

Sellers may only use Checkout for the sale of items listed on BlogShops's Services, and agree to ship sold items once a payment transaction is complete and reflected in their Payment Account. BlogShops reserves the right to terminate a seller's access to Checkout if the seller uses Checkout in any other manner.

Buyers may authorize a payment with any major credit or debit card accepted by an authorized Payment Account provider.

Third-Party Services

BlogShops uses third-party service providers to perform many of the services related to payment processing, including card processing, currency exchange, identity verification, fraud analysis and regulatory compliance.

BlogShops may share personal or transaction information with those third-party service providers that is necessary to process payments.

By using a third-party service, you may also be subject to an agreement with the third-party. For example, when you register for a payment provider account (such as PayPal), you agree to all of their terms and policies.

BlogShops's Rights and Responsibilities

Checkout functionality may be made available, modified, or discontinued by us at any time without notice and is subject to the limitations in BlogShops's Terms of Use

As a security measure, we may impose transaction limits on buyers and sellers. For example, we may impose limits relating to the value of any transaction, deposit, or adjustment, or limits relating to the cumulative value of all transactions, deposits, or adjustments during a period of time. We may also impose limits related to the number of transactions per day or other period of time. We will not be liable to a seller: (a) if we do not proceed with a transaction, deposit, or adjustment that would exceed any limit established by us, or (b) if we permit a buyer to withdraw from a transaction.

BlogShops may refuse service of Checkout to anyone, for any reason, at any time.

BlogShops reserves the right to decline transactions that we believe to be high risk, fraudulent, or in violation of BlogShops's Terms of Use.

BlogShops does not pass any secure data, including credit card numbers or bank account information to sellers. Sellers will only receive shipping information and limited buyer account information necessary to complete the order.

Seller Rights and Responsibilities

A. Store Payment Accounts Checkout is only available to sellers who register and are approved for an authorized BlogShops payment account. A Payment Account allows sellers to collect payments, issue refunds, and track revenue and fees related to transactions. In order to withdraw funds from a Payment Account, a bank account capable of receiving funds from the Payment Account is required. Payment accounts are provided to BlogShops users by authorized third-party providers. Sellers must provide accurate personal information as requested during Payment Account registration, and are responsible for maintaining and updating that information as necessary. Sellers will not impersonate any person or use a name he or she is not legally authorized to use. Sellers authorize us, and authorized agents, to verify their information (including any updated information) by accessing public records and obtaining credit reports about the sellers in order to approve a Shop Payment Account. Sellers also authorize BlogShops to verify the sellers' information from time to time while the sellers are using Checkout. BlogShops verifies sellers' information in order to safeguard the integrity of the marketplace and reduce the risk of fraud, money laundering, terrorist financing, and the violation of trade sanctions.

B. Disputes Sellers agree to resolve any disputes directly with a buyer, and in accordance with our Terms of Use. In the event that a dispute is escalated to BlogShops's Support Team, BlogShops will try to help the parties involved settle their dispute, subject to our Terms of Use.

BlogShops reserves the right to recoup funds associated with buyer chargebacks. Sellers are responsible for any chargebacks or fees that occur due to fraudulent charges made in their shops and on their Payment Accounts.

C. Communications We will inform sellers of each transaction, or of other information pertaining to Checkout, using our standard communication procedures including email, or other messaging services associated with the seller's account.

D. Refunds Sellers may provide refunds or adjustments to buyers for payments made through Checkout using the refund functionality on BlogShops. If the refund is processed on the BlogShops website and issued within 60 days from the original date of sale, then any BlogShops transaction fee assessed for the sale will be refunded in proportion to the refund amount you issue to your buyer. Important: It may also be possible for you to refund your buyer directly through your Payment Account. If the refund is processed directly between you and your buyer through your Payment Account (not on the BlogShops website), then any BlogShops transaction fee assessed for the sale will not be refunded. Note: In order to process PayPal refunds through Checkout, your PayPal account must grant API permission to the BlogShops application.

E. International Trade Laws You agree that your use of Checkout will not involve any countries, entities, individuals or items prohibited by sanctions, embargoes, regulations or orders administered by the US Department of Treasury's Office of Foreign Assets Control ("OFAC") or other government agencies.

F. Adherence to Laws You agree that your items you sell through Checkout are not in violation of any governing Local, State, or Federal laws. You further agree that the methods you use to distribute the items you sell do not violate any governing Local, State, or Federal laws.

Payment Processing Fees

A. Overview BlogShops's third party payment providers charge a payment processing fee for processing each transaction through Checkout. The fee is not controlled by BlogShops, and is subject to the terms and policies of the third-party payment processor through which you opened an account. Termination

Sellers may terminate this contract and their acceptance of Checkout at any time by closing their Payment Account with the Payment Account provider.

Terms for Sellers

Any person or entity selling items through BlogShops's Services (hereinafter referred to as "Sellers") may be charged for using some of BlogShops's services. This Fees & Payments Policy explains what fees apply to Sellers and when they are collected.

Our Terms for Sellers Policy is also a part of our Terms of Use and Checkout Policy. By opening a BlogShops shop, you are agreeing to this policy, our Terms of Use our Checkout Policy, and our Acceptable Use Policy.

Types of Fees

Sellers may be required to pay the following types of fees:

A. BlogShops Transaction Fee
When you make a sale on BlogShops, you will be charged a BlogShops transaction fee. This fee is 5% of the total sale, excluding shipping charges and sales taxes you collect.

For information on what happens to transaction fees in the event of a refund, please refer to the Checkout Policy.

B. Payment Processing Fees
In order to accept credit cards on BlogShops, you will need to have or set up a supported payment processing account (for example, a PayPal acount). This account allows your shop to process and charge credit cards and deposit earnings into your checking account. BlogShops partners with various payment providers who have their own fee schedules, but you select and set the payment provider you want to use from among the supported providers. The payment processing fee calculated by your payment provider will be deducted upon charging a transaction. Note that this fee is applied to the entire transaction amount and is in addition to any other fees.

C. Advertising Fees
If you purchase an ad (or promoted listing) through BlogShops, you will be charged a separate advertising fee. Advertising fees vary by opportunity and will be clearly outlined before you commit to purchasing an ad.

Currency Conversion

All fees charged by BlogShops are in US Dollars.

Fee Avoidance

Any action by a seller to avoid paying a fee is considered fee avoidance and is strictly prohibited by BlogShops. This includes, for example, encouraging buyers to purchase an item in your BlogShops shop through another venue. The price stated in each listing description must be an accurate representation of the sale. Sellers may not charge excessive shipping fees. Sellers may not alter the item's price after a sale for the purpose of avoiding BlogShops transaction fees, misrepresent the item's location, or use another user's account without permission.

Taxes

You are responsible for collecting and paying any taxes associated with using and making sales through BlogShops's services. BlogShops provides the tools for you to define the sales tax rate for your state including the taxability of shipping and delivery fees in your state. If for any reason the tools that BlogShops provides for defining sales tax rates do not fully satisfy the requirements for tax collection in your state, you agree to let us know and not engage in any sale on BlogShops. You are responsible for ensuring that proper taxes are collected for each sale you engage in on BlogShops and to let us know of any tax collection issues within 7 days of any transaction you are involved in that occurs through BlogShops's services.

Acceptable Use Policy

Accepting these Terms

This policy is a part of our Terms of Use and Terms for Sellers. By opening a BlogShops shop, you are agreeing to this policy, our Terms of Use, and our Terms for Sellers.

Overview

Items offered for sale through the Services (as defined in Terms) must be, at our sole discretion, appropriate for the BlogShops community. For guidance, BlogShops has established the following general item categories (hereinafter referred to as "Item Categories"): Art, Beauty & Health, Crafts & Handmade, Electronics & Technology, Fashion, Food & Grocery, Games & Toys, Home, Garden & Tools, Kids & Baby, Luxury, Jewelry, Specialty, and Sports & Outdoors. All items sold within the Item Categories must at the very minimum:

  • A. Be legal within all Jurisdictions within the United States. If an item is not legal in any state, municipality, or under federal law, you are not allowed to sell it through the Services.
  • B. Comply with all applicable regulations within the United States. Any item you sell must conform to federal regulations for that item. For example, if you are selling a cosmetic product, your labeling must conform to Federal Food, Drug, and Cosmetic (FD&C) Act, the Fair Packaging and Labeling (FP&L) Act, and the regulations published by the Food and Drug Administration.
  • C. Be family-friendly. Items that we, at our sole discretion, consider to be inappropriate for any audience are not allowed to be sold through the Services.
  • D. Show Truth in Advertising. Items sold through the Services must satisfy Federal Trade Commission guidelines for advertising and marketing.

Prohibited Items

The following types of items are prohibited from being sold through the Services:

  • Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs
  • Pornography and Adult Content
  • Dangerous Items: Hazardous Materials, Recalled Items, and Weapons
  • Animal Products and Human Remains
  • Hate Items: Items that Promote, Support, or Glorify Hatred
  • Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items
  • Violent Items: Items that Promote, Support, or Glorify Violence
BlogShops will, at its sole discretion, remove any item and/or close any shop that it considers to be in violation of this Acceptable Use Policy.

BlogShops cares about your privacy. This policy explains our privacy practices for BlogShops.com (hereinafter referred to as the "Site").

Accepting these Terms

This policy is a part of our Terms of Use. By visiting the Site, you consent to our use of your personal information in the ways set out in this policy and in our Terms of Use. This policy only applies to BlogShops's Site and services. We are not responsible for the content or the privacy policies of any third-party websites or apps.

BlogShops's Terms of Use requires all account owners to be at least 18 years of age (or have the permission and supervision of a responsible parent or legal guardian), therefore, this policy does not discuss use of our Site or services by minors.

Information Collected or Received

As a BlogShops member you are required to provide a valid email address at registration or during checkout and you may be able to choose a username or alias that represents your identity on BlogShops.

Depending on which services you choose to use, BlogShops may require additional information to provide the service, such as a shop name, billing and payment information (including billing address, telephone number, credit card information), a telephone number, and/or a physical postal address. As a BlogShops seller, you may need to provide information to our payment processing providers to accept credit card payments. These providers may require information such as your social security number, identification ID or tax ID, date of birth, bank account information, credit card information and/or other proof of identification in order to verify your identity and provide this service to you and to comply with applicable law. When providing this information to our payment processors, you are subject to their terms and policies. BlogShops does not store credit card information. BlogShops may contact individual shop owners to confidentially request more information about their shops or items listed on the Site, or to ensure compliance with our rules and applicable law. Certain products or services on BlogShops may require you to complete an application; information you submit through the application processes will not be displayed publicly and will only be used internally by BlogShops, unless otherwise specified.

You may optionally choose to provide and publicly display your full name and other personal information in connection with your account and activity. If you do not want this additional information displayed publicly, you can remove it through your account settings.

Your username, BlogShops ID or alias is publicly displayed and connected to your BlogShops activity. Other people may see the date you joined, reviews, ratings, profile information, items listed for sale, shop pages, and comments in community spaces.

BlogShops automatically receives and records information from your browser or your mobile device when you visit the Site, such as your IP address or unique device identifier, cookies and data about which pages you visit on the Site. This information helps us to prevent fraud and keep the Site secure, analyze and understand how the Site works for members and visitors, and provide a more personalized experience for members and visitors.

Some members or visitors may connect to BlogShops or register an BlogShops account using an external third-party application, such as Google. BlogShops may receive data from those connected third-party applications. Connecting your BlogShops account to third-party applications or services is optional, and when you connect your account to an external app, you will be granting BlogShops permission to receive information from the third-party applications. You can also choose to share some of your activity on BlogShops on certain social media networks which are connected to your BlogShops account. You can modify your settings and revoke your permission under your BlogShops account settings.

BlogShops may receive or obtain information (for example: an email address) about a person who is not yet a registered BlogShops member (a "non-member") in connection with certain BlogShops features, such as when a non-member subscribes to a BlogShops newsletter, a member invites a non-member to visit the Site, or a non-member engages in a guest transaction. Non-member information is used only for the purposes disclosed when it was submitted to BlogShops. A non-member can contact us if they do not want BlogShops to retain their information.

Choice & Control

We know that members of our community value having control over their own information, and therefore BlogShops gives you the choice of providing, editing or removing certain information, as well as choice over how we contact you.

You may change or correct your BlogShops account information (except your email address) on the Site. You may also remove certain optional information on the Site that you no longer wish to be publicly visible on the Site, such as your profile image.

For various reasons, BlogShops may send you messages about our services or your activity. Some of these messages are required, service-related messages for members (such as transactional messages or legal notices). Other messages are not required, (such as newsletters), and you can control which optional messages you choose to receive by changing your settings in your account.

If you have chosen to connect your account to an external, third-party application, such as Facebook, or an app developed using the BlogShops API, you can change your settings and remove permission for the app by changing your account settings.

If you no longer wish to use BlogShops's services or receive service-related messages, then you may close your account under account settings.

Messages from BlogShops

Some messages from BlogShops are service-related and required for members. Examples of service-related messages include an email address confirmation/welcome email when you register your account, notification of an order, and correspondence with BlogShops's support team. You may not opt out of receiving service-related messages from BlogShops, unless you close your account.

BlogShops may also send you messages related to certain features or your activity on the Site. BlogShops may send you news or updates about changes to our Site or services. From time to time, we may develop new types of messages and share them with you to inform you about our services. Primarily, members will receive these messages via email or push notifications.

BlogShops offers optional email newsletters. When you register for an account, or choose to subscribe to a newsletter, you will receive newsletters from us. Newsletters are available to both members and non-members. Members may subscribe or unsubscribe from optional newsletters under account settings or by following the instructions contained in the newsletter emails. Non-members may subscribe by providing an email address, which will only be used by BlogShops for these newsletters. Non-members may unsubscribe from newsletters by following the instructions contained in the newsletter emails.

Community

BlogShops is both a marketplace and a community. We offer several features that allow members to connect and communicate in public or semi-public spaces. Please use common sense and good judgment when posting in these community spaces or sharing your personal information with others on BlogShops. Be aware that any personal information you submit there can be read, collected, or used by others, or could be used to send you unsolicited messages. BlogShops generally does not remove content from community spaces, and your posts may remain public after your account is closed. You are responsible for the personal information you choose to post in community spaces on BlogShops.

Another BlogShops member may follow your public activity on BlogShops to receive updates, such as when you add an item to your public Favorites.

Information Uses, Sharing & Disclosure

We respect your privacy. BlogShops will not disclose your name, email address or other personal information to third parties without your consent, except as specified in this policy. We generally use the information to provide and improve our services and products, for billing and payments, for identification and authentication, for targeted online and offline marketing, to contact members or interested parties, and for general research and aggregate reporting.

BlogShops limits access to your personal information by BlogShops personnel to those whom we believe reasonably need that information to provide products or services to you or in order to do their jobs.

As part of the buying and selling process, BlogShops will facilitate the sharing of information between the two members involved in the transaction, such as the other BlogShops member's email address, shipping address, and payment information. By making a purchase on BlogShops you are directing us to share your information in this way. We expect you to respect the privacy of the member whose information you received. As described in BlogShops's Terms of Use, you have a limited license to use that information only for BlogShops-related communications or for BlogShops-facilitated transactions. BlogShops has not granted you a license to use the information for unsolicited commercial messages or unauthorized transactions. Without express consent from that person, you must not add any BlogShops member to your email or physical mailing list or misuse any member's personal information. Remember that you need to comply with all relevant legal rules when you use BlogShops. This includes applicable data protection and privacy laws which govern the ways in which you can use another BlogShops member's information.

BlogShops may release your personal information to a third party in the following circumstances: to protect, establish, or exercise our legal rights or defend against legal claims; to comply with a subpoena, court order, legal process, or other legal requirement; or when we believe in good faith that such disclosure is necessary to comply with the law, prevent imminent physical harm or financial loss, or investigate, prevent, or take action regarding illegal activities, suspected fraud, threats to our property, or violations of BlogShops's Terms of Use.

BlogShops is affiliated with a variety of businesses and works closely with them. These businesses may offer promotions (including email promotions) or sell items or services to you through BlogShops's services. BlogShops may also provide services or sell products jointly with affiliated businesses. When an affiliated business is associated with your transaction, we may share information related to the transaction to facilitate the transaction.

BlogShops may share demographic information with business partners, but it will always be aggregated and anonymized, so personally-identifiable information is not revealed.

BlogShops may engage third party companies and individuals (such as payment processors, research companies, analytics and security providers) to help provide our services. These third parties have limited access to your information only to perform these tasks on our behalf and are obligated to BlogShops not to disclose or use your information for other purposes.

In some cases, BlogShops may choose to buy or sell assets. In these types of transactions (such as a sale, merger, liquidation, receivership or transfer of all or substantially all of BlogShops's assets), member information is typically one of the business assets that is transferred. Third-party plug-ins also may collect information about your use of the Site. For example, when you a load a page on BlogShops that has a social plug-in from a third-party site or service, such as a "Like" or "Send" button, you are also loading content from that third-party site. That site may request cookies directly from your browser. These interactions are subject to the privacy policy of the third-party site. In addition, certain cookies and other tracking mechanisms on our site are used by third parties for targeted online marketing and other purposes. These technologies allow a partner to recognize your computer or mobile device each time you visit BlogShops, but do not allow access to personally identifiable information from BlogShops. Security

The security of your personal information is important to us. Your BlogShops account information is protected by a password. It is important that you protect against unauthorized access to your account and information by choosing your password carefully, and keeping your password and computer secure, such as by signing out after using our services.

BlogShops encrypts sensitive information (such as credit card numbers) using secure socket layer technology (SSL). BlogShops follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once BlogShops receives it. Unfortunately, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.

Data Retention

BlogShops will retain your information only for as long as is necessary for the purposes set out in this policy, for as long as your account is active, or as needed to provide you services. If you no longer want BlogShops to use your information to provide you services, you may close your account. BlogShops will retain and use your information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

You may inform us of any changes or requests regarding your personal data, and in accordance with our obligations under applicable data protection law, we may update or delete your personal data accordingly.

Privacy Policy Changes

We may update this policy from time to time.
